1. Acceptance of Terms

By accessing or using Avocado Fund ("the Protocol"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Protocol. Avocado Fund is a decentralized, non-custodial lending protocol deployed on public blockchain networks.

2. No Financial Advice

Nothing on this platform constitutes financial, investment, legal, or tax advice. Participation in DeFi protocols carries substantial risk, including the complete loss of deposited funds. Always conduct your own research (DYOR) before interacting with any smart contract or decentralized protocol.

3. Risk Disclosure

Using Avocado Fund involves significant risks including but not limited to:

  • Smart contract vulnerabilities and exploits
  • Liquidity risk — inability to withdraw at desired times
  • Oracle failures or price manipulation
  • Regulatory risk and changes in law
  • Counterparty default risk on borrowed funds
  • Stablecoin depeg events (e.g. USDC)
  • Network congestion or gas price spikes

You acknowledge that you understand these risks and accept full responsibility for any losses incurred.

4. Eligibility

The Protocol is not available to residents of the United States or any jurisdiction where the use of decentralized finance protocols is prohibited. By using the Protocol, you represent that you are not located in a restricted jurisdiction and are of legal age in your jurisdiction.

5. Protocol Fees

The Protocol collects a performance fee on interest earned by lenders. Current fee schedules are visible on-chain and may change subject to governance. Fees are deducted automatically from yield before distribution to depositors.

6. Intellectual Property

The Avocado Fund interface is open source. Smart contracts are deployed on-chain and are permissionlessly accessible. The Avocado Fund name, logo, and brand assets are owned by Avocado Labs and may not be used without permission.

7. Limitation of Liability

To the maximum extent permitted by law, Avocado Labs and its contributors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Protocol. The Protocol is provided "as is" without warranty of any kind.

8. Governing Law

These terms shall be governed by the laws of the British Virgin Islands, without regard to its conflict of law provisions.
